Resumen

The reduction of working hours when the minor is neurodivergent is not expressly contemplated in labor regulations. However, in many cases they require direct, continuous and permanent care as if they had a serious illness or cancer that requires constant assistance with various therapies. In addition, the minor may have a recognized disability that certifies the need for help with daily living according to the 2022 scale. This article analyzes whether the parent, guardian for adoption purposes or permanent foster carer, can exercise his or her right to reduce working hours for caring for a minor with cancer or a serious illness if the minor is neurodivergent and does not have other serious ailments diagnosed. Finally, possible solutions are provided to integrate neurodivergence more transparently into labor regulations.
