Despoblación y nivelación financiera municipal en el marco de la Carta Europea de Autonomía Local

Abstract

La lucha contra la despoblación requiere de gobiernos locales fuertes, y esto incluye una financiación municipal adecuada. Sin embargo, tal y como ha declarado el Congreso de Poderes Locales y Regionales del Consejo de Europa en su Recomendación 465 (2021), España carece de un sistema de nivelación financiera intermunicipal que proteja a los municipios con mayor debilidad financiera, tal y como exige el art. 9.5 de la Carta Europea de Autonomía Local. En consecuencia, España debería introducir una corrección de fondo en la Ley de Haciendas Locales. Esa reforma debe responder a las exigencias de la Carta Europea, tal y como la ha interpretado y aplicado el Consejo de Europa.
