Abstract

Tras la entrada en vigor de la LO 6/2007 de reforma parcial de la del Tribunal Constitucional, si este Alto Tribunal, con la complicidad del legislador, ha decidido delegar su deber constitucional de restablecer o preservar los derechos fundamentales en los Tribunales de Justicia a través del incidente de nulidad de actuaciones, el mismo ha de resultar, cuando menos, eficaz para los justiciables, para lo cual es imprescindible modificar la competencia de ese incidente atribuyéndola a un órgano judicial distinto del que dictó la resolución judicial definitiva y firme.
