Abstract

German contracting authorities usually enter into «open-house» contracts in order to purchase pharmaceutics. These contracts are concluded with no competitive tendering procedure. Every economic operator fulfilling the requirements established by the contracting authority enters into an identical contract. The contracting authority does not designate an economic operator to whom contractual exclusivity is to be awarded, nor can it limit the number of participants. On the other hand, interested economic operators submit no tender, they only have to prove that they can meet the contracting authority´s needs. The German legal community has discussed over the years whether these contracts breach EU public procurement law. The CJEU has settled the debate, confirming that these contracts fall outside the scope of EU Directives because there is no contracting authority´s selection decision involved. This work discusses the emergence of «open-house» contracts in German law and the EU law approach thereto. See below a notion of «open-house» contracts tied to a specific legal regime, particularly regarding procedural aspects. Finally, there is a discussion on the status of «open-house» contracts within Spanish law.

This may be a notable indicator of future more formal and academic citations. This claim is supported by the result of the "Capture" indicator, which yields a total of: 20 (PlumX).

It is essential to present evidence supporting full alignment with institutional principles and guidelines on Open Science and the Conservation and Dissemination of Intellectual Heritage. A clear example of this is:

Continuing with the social impact of the work, it is important to emphasize that, due to its content, it can be assigned to the area of interest of ODS 16 - Promote peaceful and inclusive societies for sustainable development, provide access to justice for all and build effective, accountable and inclusive institutions at all levels, with a probability of 42% according to the mBERT algorithm developed by Aurora University.
