Abstract

In any social organization we find objective realities that are affected by its existence and development. At the same time, we find realities that belong individually to each of the units that comprise it. Both manifestations demand from the higher group a legal regulation whose expression is always in accordance with the structure of the specific community in which they are integrated. Within the framework of the gens prior to the Roman urban formation, the law of things presents peculiarities that are related to the specific nature of the power that gentile society had over them and to the realities on which said legal power was projected. In this environment, the interest of the gentile group becomes a key element for its structuring.
